These Terms of Service ("Terms") are an agreement between you and S3LF M4D3 US LLC ("S3LF M4D3", "we", "us"), the company that operates SM1 and the website at sm1health.com (the "Site"). They cover your use of the Site and everything you buy from us.

Please read them before you order. When you place an order, create an account, or use the Site, you are telling us that you have read these Terms and agree to them. If you do not agree, please do not use the Site.

We have written these Terms in plain English on purpose. Where a term has a specific legal meaning, we say so.

Our store runs on Shopify, which provides the ecommerce platform used to process transactions and deliver our services.

1. Who can buy from us

You must be at least 18 years old and able to enter into a contract where you live. By ordering, you confirm that you meet both conditions and that the information you give us is accurate and your own.

SM1 is sold for personal use. You may not buy from us to resell, redistribute, or list our products on any marketplace without our written permission.

We ship to the destinations shown at checkout. If your address is not accepted at checkout, we do not currently ship there.

2. Your account

You can order as a guest or create an account. If you create one, you are responsible for keeping your login details private and for everything that happens under your account. Tell us straight away at hello@sm1health.com if you think someone else has access to it.

We may suspend or close an account that we reasonably believe is being used for fraud, resale, or abuse of our guarantee.

3. About the product, and what it is not

SM1 Capsaicin Power is a dietary supplement sold in softgel form. It is a food supplement, not a medicine.

SM1 is not medical advice and is not a substitute for care from a qualified health professional. Nothing on the Site diagnoses, treats, cures, or prevents any condition, and nothing on it should be read as a promise of a particular health outcome. Talk to your doctor before taking SM1 if you are pregnant or nursing, are under 18, have a medical condition, or take prescription medication — particularly blood thinners, blood pressure medication, or diabetes medication.

Stop taking SM1 and speak to a doctor if you have any adverse reaction.

Individual results vary, and depend on factors such as age, health, and genetics. Customer stories on the Site describe the experience of the person telling them, and are not a prediction of what you will experience.

We do our best to show product images, ingredient information, and labels accurately. Screens differ, and packaging changes from time to time, so the product you receive may look slightly different from the images on the Site. The label on the bottle you receive is always the authoritative one — read it before use.

4. Orders

Your order is an offer to buy. The order confirmation email we send is an acknowledgement that we received it, not our acceptance of it. The contract between us is formed when we dispatch your order.

We may decline or cancel an order, in whole or in part, at any time before dispatch. Reasons include a product being out of stock, a pricing or description error, a payment we cannot verify, a delivery address we cannot ship to, or an order that appears to be for resale or to be abusing a promotion. If we cancel after you have paid, we refund you in full.

There are quantity limits on some orders and promotions. We may enforce them per person, per household, or per payment method.

5. Prices, payment and taxes

Prices are shown in the currency displayed at checkout and can change at any time before you order. The price that applies to your order is the one shown at the moment you complete checkout.

You confirm that you are authorised to use the payment method you give us. Payment is taken at checkout by our payment providers, and your card details are encrypted in transit. We never see or store your full card number.

Sales tax is calculated at checkout where it applies. If your order ships to a destination outside the country it is sent from, you are responsible for any import duties, taxes, or customs fees — these are not included in the price and are not refundable by us.

6. One-time purchases only — there is no subscription

Every order on the Site is a single, one-time purchase. We do not operate a subscription programme, there is no automatic renewal, and we will never bill you again on a recurring basis. Our multi-bottle bundles are exactly that — more bottles in one shipment at a lower price per bottle. They are not a recurring plan, and there is nothing to cancel after your order arrives.

If you ever see a repeat charge from us, it is an error. Contact us at hello@sm1health.com and we will investigate and refund it.

7. Shipping and delivery

Orders placed on a business day are dispatched from our United States facility within 24 hours. Orders placed at a weekend or on a public holiday are dispatched on the next business day.

Once dispatched, most orders arrive within 3 to 5 business days. You will receive a tracking link by email when your parcel leaves us.

Delivery times are estimates, not guarantees. Once a parcel is handed to the carrier, its progress is out of our hands. Weather, carrier backlogs, customs, and incorrect or incomplete addresses can all add time, and we are not liable for delays caused by them. What we will always do is help you chase a parcel that has gone astray — write to us and we will work it out with you.

Risk of loss passes to you when the carrier delivers the parcel to the address you gave us. If a parcel is marked delivered but you cannot find it, contact us within 14 days and we will help you open a claim with the carrier.

Please check your delivery address carefully before you pay. We cannot redirect a parcel after dispatch, and a parcel returned to us because of a wrong address may be re-shipped at your cost.

8. The 120-Day Money-Back Guarantee

We offer a 120-day money-back guarantee on every order. If SM1 is not right for you, write to hello@sm1health.com within 120 days of the date your order was delivered and we will refund what you paid for the product.

How it works:

• The guarantee covers the product price. Shipping paid at checkout, and any duties or taxes, are not refunded.
• It applies to opened and unopened bottles alike. You do not have to prove you finished the bottle, and we will not ask you to justify your decision.
• It is limited to one guarantee claim per person or household. It is a genuine offer for people trying SM1, not a way to obtain repeat orders for free.
• You do not need to send anything back. Returns are not required, and we do not accept them — please keep or dispose of the remaining product.
• Refunds go back to the payment method you used. Once we approve a refund, it usually reaches your account within 5 to 10 business days, depending on your bank.

If your order arrives damaged, incomplete, or is not what you ordered, this guarantee is not the route — just tell us within 14 days of delivery, send a photo if you can, and we will replace it or refund it in full, including shipping.

Nothing in this section affects any right you have under the consumer law where you live. Where that law gives you more than this guarantee does, that law applies.

9. Promotions and discount codes

Promotions, discount codes, and bundle pricing are offered for a limited time and may be changed or withdrawn at any time. Unless we say otherwise, codes cannot be combined, have no cash value, and cannot be applied to an order after it has been placed.

We may cancel an order and void a code that has been obtained or used in a way it was not intended for.

10. Our content

The Site and everything on it — text, images, photography, video, layout, design, graphics, and the SM1 name and logo — belongs to S3LF M4D3 US LLC or is used by us under licence. It is protected by copyright, trade mark and other laws.

You may view, download, and print pages from the Site for your own personal, non-commercial use. You may not copy, republish, sell, scrape, or use any part of the Site to build another product or service, or use the SM1 name or logo, without our written permission.

11. Things you send us

If you send us a review, photograph, comment, suggestion, or any other content, you keep ownership of it. You give us a worldwide, royalty-free, perpetual licence to use, reproduce, adapt, and display it in connection with our business, including in marketing, and you confirm that the content is yours to give and that it does not infringe anyone else's rights.

We do not have to keep anything you send us confidential, pay you for it, or use it at all. We may remove content we consider misleading, offensive, or unlawful.

12. Things you must not do

You agree not to use the Site to break the law; to impersonate anyone; to submit false or misleading information; to upload malicious code; to interfere with the Site's security or operation; to scrape or harvest data from it by automated means; or to attempt to gain access to any part of it that is not meant for you.

We may suspend or terminate your access if you do any of these things.

13. Other websites and services

The Site may link to websites and services we do not run. We link to them for convenience and we do not control, endorse, or take responsibility for their content, products, or privacy practices. Read their terms before you use them.

14. Shopify's role

The Site runs on Shopify. Shopify provides the ecommerce platform and processes information on our behalf; it does not sell you the product, and it is not responsible for the product, for our claims about it, or for these Terms. Your contract for the product is with S3LF M4D3 US LLC.

15. Privacy

Our Privacy Policy explains what personal information we collect, why, who we share it with, and what rights you have over it. It forms part of these Terms.

16. Errors and corrections

Occasionally something on the Site may be wrong — a price, a description, an availability figure, a delivery estimate. We may correct any error and update or cancel an affected order at any time, including after you have submitted it, without being obliged to give notice first. If we cancel a paid order for this reason, we refund it in full.

We do not undertake to keep every piece of information on the Site up to date, and you should not treat a date on the Site as a promise that nothing has changed since.

17. Disclaimer of warranties

We take real care over the Site and the product. Even so, and to the fullest extent the law allows, the Site and everything on it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any content on it is accurate or complete.

Some jurisdictions do not allow the exclusion of implied warranties. Where that is the case, the exclusions above apply to you only as far as that law permits, and nothing here removes a right you cannot legally give up.

18. Limitation of liability

To the fullest extent the law allows, S3LF M4D3 US LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the Site or any product bought through it.

Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid us for the order that the claim relates to.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.

19. Indemnity

You agree to indemnify and hold S3LF M4D3 US LLC harmless from any claim, loss, or expense (including reasonable legal fees) brought by a third party because you broke these Terms, misused the Site, or infringed someone else's rights.

20. Resolving a dispute

Talk to us first. Almost everything is solved by an email. Before starting any formal proceeding, please write to hello@sm1health.com with your order number and a description of the problem, and give us 60 days to put it right. Most disputes end here.

If we cannot resolve it that way, any dispute arising out of or relating to these Terms or to anything you bought from us will be resolved by binding arbitration on an individual basis, rather than in court, and class actions are not permitted.

You can opt out of this arbitration agreement. Email hello@sm1health.com within 30 days of your purchase, saying that you opt out and giving your order number. Opting out costs you nothing, changes nothing else in these Terms, and will not affect your order, your price, or your guarantee.

Either of us may still bring an individual claim in small claims court, and either of us may seek an injunction to protect intellectual property, without going through arbitration.

21. Governing law

These Terms are governed by the laws of the United States and of the state in which S3LF M4D3 US LLC is organised, without regard to conflict-of-law rules. Where the law that applies where you live gives you rights that cannot be overridden by agreement, those rights continue to apply to you.

22. Changes to these Terms

We may update these Terms. When we do, we change the "Last updated" date at the top and post the new version on this page. Changes apply to orders placed after they are posted; the version in force when you ordered governs that order. Please check this page from time to time.

23. Termination

These Terms apply while you use the Site. We may end your access at any time if you break them. Sections 10, 11, 17, 18, 19, 20, and 21 survive the end of this agreement.

24. General

If any part of these Terms is found to be unenforceable, that part is severed and the rest stays in force. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any policy referenced at checkout, are the whole agreement between us and replace anything said earlier. Headings are for convenience and do not affect meaning.
